Since you guys like these kinds of drawings:
Blue is for the truck
Black is for the elantra
Snow+brakes+horn=useless
http://www.elantraxd.com/forums/attachment.php?attachmentid=4179&stc=1
Damage:
Driver's side door dented and scratched
Driver's side mirror ripped off, hanging by the wires
Driver's side fender pushed in
Front bumper cracked
To top it off... The driver is illiterate and I had to talk to his boss. Going to go sign some papers tomorrow, and I'm bringing my special friend who knows how to persuade people (or they get hurt, badly).
Hopefully this will work out and the insurance will pay for it. I know my premiums will go up, but I am not shelling out more money for body repairs.
I need to go workout now.
FUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU UUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU UUUUUUUUUUUUUUUUUUUUUKKKKKKKKKKKKKKKKKKKKKKKKKKKKK KKKKKKKKKKKK

wow, that sucks man! and I thought I was having a bad day. Your premiums shouldn't go up if its 100% the other guys fault. (that is a rather large assumption)
So the dude cut you off?Thats messed up man.At least you didnt get hurt.Sorry to hear bout your car

yeah wtf bro~!
your premium shouldnt go up if its not your fault
in fact, last time some old ***** hit me, I didnt even have to notify my insurance
everything went through hers, and I got my fat check~!
Anyways, glad to hear that you are okay

illiterate meaning he can;t read or he can;t speak english?

Dude, that sucks, although I'm not surprised that idiot pulled sh1t like that here... I see it a lot, luckily I haven't been in the a$$ end of it...
I almost rear ended this taxi downtown yesterday cuz he decided to just stop and shift into N so his brakes lights were off. I almost got out of my car and kicked in his doors...

yeah, no offence, but a lot of montreal drivers suck!! A lot of Ottawa drivers do as well, but I find that Montreal is a little worse...

Yeah I am grateful that I'm alright myself...
Although I don't think they are liable for damage, apparently since 2001 laws about insurances have changed (at least in Canada) and the insurance companies have to take care about any damage caused to the insuree's (if that word even exists) vehicle, whether the person is responsible or not.
Great. Just great. That was exactly what I needed.
What pisses me off the most is that I was just at the wrong place at the wrong time. If I had left school 30 seconds later it wouldn't have happened.

il·lit·er·ate Audio pronunciation of "illiterate" ( P ) Pronunciation Key (-ltr-t)
adj.

Nah he spoke... Just unable to write... I tell him my name, he writes Phelikz, and when he was spelling out stuff he said Q instead of K and whatnot... Good thing I can read properly LOL

hmm, this has me thinking about the accident I was in at work last week. A work van from another company backed into me in a t-bone in my work van (luckily I only had one of the individuals in the car with me). Anyway, I wonder if this will get back to my insurance company. More of a rhetorical question really...no need to answer.

sorry to hear about that felix.. hope it gets fixed soon and is not on your shoulders! :)

Just adding some junkyard horns to my stock horn (resulting in a surprisingly ugly hong) seems to get more attention from other drivers (they all look to see what makes such an ugly noise).

Since it's being settled sans insurance, just make sure you "go deep" with the estimates e.g. get them to assume that everything's fubared even if there isn't so you're not shortchanged in the end or whatever.

My dad (1997 Silverado) was driving along and some a**hole made a left and turn in fron of him from a side road on the right hand side of the road. My dad trie to turn to avoid the collision, but the guy turned the same way. CRASH!!!!! Dad's truck was TOTALLED! My dad is a carpenter and tools went flying through his rear window. He picked up a saw from the yard 100 some feet away. A piece of styrofoam he had behind his seat flew up and protected his head. A month+ later, after my dad put a down payment on a new truck with insurance money, the guy's insurance company called asking if he would accept 20% fault... he said 'Hell No!"
Glad you're all right. Car sounds like it may look like mine almost. :(

Yeah car kinda looks like yours, minus headlight and frame damage, plus my door and mirror is ****ed.
The headlight has some scratch on it on the bottom but it can be buffed out quite easily, i dont feel like buying a new healight, though i will make the guy believe i need a new one.

UPDATE:
So the driver was refusing any liability. The company itself wasn't helping. I decided to take the matter into my own hands.
We went to the company this morning. Owner is an asshole and was playing with a knife while we were talking to him. Trying to scare me? Haha, nice try. After a bit of talk and analysing, we found some nice things out. It's actually an apartment. And... of course, non-declared (illegal!) business. Strike one, ***** :)
So we go meet the driver a little further and make him fill in the information sheet for the accident. So he fills in the info, except for the registration part, because the truck itself was being used somewhere else on that day. Alright, no problem. He makes a little drawing of the accident (as required on the sheet), where he showed that where he wanted to turn was a 2-lane round point, which was BS. Whatever, I got a nice plan at that point. Good, so he allegedly admitted being in the center lane before the accident. Now, to prove that it's actually a single-lane round point, we went there and took a picture of the intersection to prove he had done an illegal manoeuvre. Strike 2, ***** :)
Now... Since we were missing the registration info we asked them where the truck was and they actually told us (btw it's a moving/transportation company), so we went there. Got there, grab the info, and bam. Something else. We realize that his passenger side mirror is broken and re-taped on, though in an angle which points back to the truck itself, making the mirror useless. That means that his mirror being non-functional, there was no way that he couldve seen me, no **** he hit me in the side. So, we take a picture of the broken/ghetto rigged/not functionnal side mirror. Strike 3, ***** :)
Also, after signing the paper, he forgot to take a copy for his own use. That means I can modify the drawing and his comments however I like, and you know what, I don't care WHAT he says after he finds out from his insurance company, he deserves to be fuked over because he's a liar and he's the one causing all this because he's a poor trucker that can't afford paying more insurance. Too bad. Boo fukin hoo. Poor or rich, if you don't know how to drive and actually deny the responsibility of your acts, you deserve to be screwed over. That said: Strike 4, ***** :)
1,2,3,4, you're out. On monday this will be one-day mailed to my insurance company so they can declare him 100% at fault. Once that's done I will think of what I will do, declare, or not? It depends if my insurance company is able to make his company pay them back (sometimes it happens), in that case, my premiums shouldn't go up and I should be alright.
I just want this to end, I haven't driven my car since the accident (except for the test drive after installing my tranny linkage bushings (hotness btw)), cause my mirror being broken, I don't want any water getting in there and frying all harnesses (AGAIN).

yeah, definately. Way to go Felix! Did you take the pictures with a digital camera? A lot of places (Gov't and what not) aren't accepting digital photos anymore because of how easy it is to change them before you send them in. Check with your people and find out, you may need to get the pictures again on a film camera if need be.
Anyway, like I said at the beginning, way to go man!

They won't necessarily accept the digipics, but there is enough information for the insurance company to go back and verify all that stuff- the mirror, the intersection, etc.
