Alright.. so i'm on my way home from school in albany... around 3:30 today and its a 4 lane street.. 2 roads on each side... and i come to this intersection and i get stuck behind someone that is turning left, they proceed to turn and I start to go straight... then this stupid asian ***** runs into me.. I'm going straight and she scraps into me... I'm in my own damn lane... and she came into my lane! I pull over because im pissed as hell... and before im even out of the ****ing car this ***** is out and accusing me of hitting her.. i didnt hit her. i know most girls arent the best drivers. but i know how to stay in my own damn lane... so i call the insurance company and let them know what happen, we exchange information.. after 5 minutes of trying to explain why i needed it.. It wasn't even the girls car... it was her sisters. after everything happened... shes like what do i do? What do you do? are you stupid? go the a body shop and get an estimate.. call your insurance... this girl was clueless... and just a minute ago writing this, she calls me, and is like, why did you tell your insurance it was my fault, well because it was! I didn't say anything because its not good to start pointing fingers after an accident like that, it just pisses people off.... so now we get to wait and see what happens... and how much my car is covered.. ugh. ... stupid girl....

This reinforces my belief that we need harder drivers tests.

And actually enforce the cell phone laws or one's like it. There are to many things to distract driver's these days.

I always use my hands free set and have no problems.
Granted, most of the times I use my cell phone are during long haul night trips home (~3 hours) when the roads are deserted...

what does her being asian have to do with anything? please refrain from any racial comments.
always call the police after any accident to get an icident report so you have something to go with an INS claim.

^ Ditto on both accounts. Without an accident report all you'll get is a no-fault that goes against your insurance.

First thing to do (after assessing the scene for safety/injury), call the police. You HAVE to file a report, otherwise it's your word against theirs.

look at you like it's your fault. Even if it is CLEARLY their fault,
they get out. They're like:
"Alright, why did you stop at a red light
and let me hit you doing 80?! WHY DID YOU STOP AT A RED LIGHT?"

And never say or do anything beyond making sure nobody is in immediate danger before calling the cops. Wait for the cops to arrive so they can document everything.

Sorry that happened, gash. As far as getting the police out there, the way it works here in Texas is they say if both cars are driveable and no one is hurt, you're just supposed to exchange information and deal with it yourselves. If you can, file a report with the local police department. If you do and she doesn't, your statement will be the only evidence on file if it ever goes to court, which will count in your favor.
