Hah! Well, I kind of agree, you really should read every single part of the auction. With that said, I don't know how these people think they can get away with it.

I should buy one of those PS3 boxes for like $407 and then sue the person.

I can't stand Judge Judy. I would never go to her court on anything because I would end up hitting her by the end of it. Regardless if she is a scammer or not I think it was pretty unprofessional to be tossing the insults out at her. 5000k was justified because she did violate the spirit of the law. All the other jib jab isn't needed and is the reason I can't stand Judge Judy.

my neighbor was on it years ago. daughter went on a camping trip with her dad, friend went, another friend brought a knife, friend #1 tried to sue mom, judge basically said mom has nothing to do with it, goodbye!

judge judy's a b!@#$ she is being slanderous and biased in her decision. Countless of times do I go on ebay and there is an auction for a link to a website that tells you how to get a PS3 for $50 and the bid is at like $250. If the buyers do not read everything on the page, it is not the sellers fault. Ebay protects its customer in every manner possible is fraud is evident and Ebay deemed it as not fraud as they can see the auction and possibly the statement that the auction was for a photo only. If it is fraud Ebay would be the first to step in for the sanctity of their online auction website. Judge Judy is being biased because she is an old lady and probably is stepping in her shoes as how she would feel being on ebay, but according to the judicial system, the law is blind. If I was the seller I would have kept my mouth shut when I was given the print outs of the auction and just showed the judge where the statement was made that it was for pictures. As for her telling her about child protection services and income tax, those are slanderous statement that the seller may bring to a higher civil court and the footage itself is sufficient for a case, that is defamation of character and the fact that it is being done over broadcast television makes a bigger impact. Sorry for the buyers but they were idiots for not reading, like she said, they were probably on a shopping spree, saw an auction with the picture of a phone and thought ooh cheap and bid like a dumb ***.

And remember the law is not based on public or even the judges opinion, but what really happened and what the facts are. Her say that she believed that the defendants husband said those things over the phone can also be called to attention as there is no proof of a conversation other that the statement made by the plaintiff and simply put that should not suffice.

Keep in mind that a preponderance of the evidence is all that's required in most civil courts. It's up to the judge to determine if that exists.

The plantiff actually had the conversation with the defendant's husband. Why would that not be allowed as part of her testimony?

Also, the people on those judge shows provide all kinds of information to the judge prior to them being taped. There's much more information available to the judge than what you see in the 30 minute show.

in that instance it makes more sense, but regardless of it the plaintiff can say she talked to the seller's husband and the defendant may say that that is a lie. In essence it would be one person's word against the other, or in her case two against one since the daughter was there and the seller's husband was not there. The seller was not even given the opportunity to defend herself as the Judge started squawking about irrelevant matters and throwing insults. The defendant was ill prepared and the judge was biased in her decision. I've gotten f!@#ed over on ebay as well, but not because of my own neglect, me not reading the entire posting, but because the seller sent me the wrong items after paying $150 for shipping of rims. I settled it with him outside of court but in this case the action was his mistake. The way the judge saw it was, "What if this happened to me," and that is not how it is supposed to be taken by the law, but as, "does the evidence provided prove that the plaintiff's case is true and that the defendant is guilty of the charges." In this case if the post did state that "This auction if for a picture only," then who is at loss, the person who posted the auction with a warning, and yes quite possibly to get an idiot like the plaintiffs to buy it, or the plaintiff who did not read it all and bid like an idiot that she is. I've known people that have sold things like hard drives in the same manner and they post there that the item is damaged but great for getting parts from it and people bid, if they don't read the entire post whose fault is it?

See thing is for someone that has been in court before, I hate it when I see judges have a biased opinion regarding the culpability of the defendant. Most judges have this problem, that you walk in as a defendant and despite the fact that you are innocent until proven guilty, he/she has already judge you guilty, simply because you are to his right with the "Defendant" sign in front of you. The law should be blind, but it apparently is cheating and trying to peek with one eye. Judge Judy judged the defendant before she even got to defend herself. Other than that, my girl watched it with me and doesn't the daughter look sorta of like amy lynn spears at times?
