I was talking about this with friends at work the other which is why I am bringing an old story up. Last year sometime, I was watching Cops. They were doing this one operation that seemed like obvious entrapment. They go into the middle of the f'in ghetto with a $13,000 Mercedez Benz mountiain bike. They leave the bike, unchained, up against the wall of a corner bodega and just sit up the block and wait for random stupid mother****ers to steal the damn bike. They did it numerous times. Who wouldn't steal a goddamned Benz bike that's just sitting there? I just think this was a ****ed up operation to run. There's our tax dollars well spent!

By that definition, I don't believe it would be entrapment. They were not deceiving or coercing an innocent person to steal the bike. They were luring a guilty person.

Think of it this way....What is the likelihood that the police are going to be there watching when you park you car (or bike or whatever) on the street and someone breaks into it and drives it away? Not very. It's nice to see the criminals who have the balls to grab something that doesn't belong to them right off the street get caught.

If I saw an expensive bike ssitting on the street unattended (the li9ttle criminal in the back of my head would say if you take that you are a dumbass) Of course someone is watching it. Nobody leaves something of value unlocked and unattended anymore and if you are naive enough to do so you deserve to have it ripped off.

i think doing the whole trap car, or planted bike thing in areas that are prone to having crimes committed based on the poverty is wrong. they don't plant cars or bikes in wealthy neighbourhoods because they know they don't have a good chance of nabbing anyone. they put it in these areas because they know they can turn anyone into a criminal

That is entrapment to a certain degree. Usually entrapment is when a law official gets someone commit a crime they normally would normally not commit. If the person who steals the bike has a clean record, never been arrested, he can use entrapment and it may hold in court. Personally I would have stood next to it for a few minutes to see if someone came to claim it and then would have taken it. If I had a clean record I could use both entrapment and state the fact that I was going to bring it to the police station had I not been arrested before doing so. They cannot simply arrest you for grabbing it, they need to see what you were going to do with it. It's like stopping to ask a hooker for directions. You can get burned. But yeah it can be entrapment. As for the arrested part, public defenders are stupid and want to get rid of you quickly, so the best thing to do is to know the law and simply use the dumbass to do the paper work and talking for you. Thats how I kept myself out of prison.

I think that dishonesty is dishonesty no matter what your financial standing. There are rich criminals too.

I don't necessarily buy the direct correlation between being poor and stealing from others. I know plenty of people who don't have a whole lot of money but they aren't running around stealing from others nor are they keeping their eyes open for seemingly abandoned merchandise.

All kinds of people steal. Not just poor people. Put that Mercedes bicycle in a rich neighborhood and I guarantee you'll get some takers.

I just remembered I had one of bmx bikes stolen from my parents house. In broad daylight several neighbors saw it happen, nobody did anything about it. I found out who it was, and since the kid was under 18. I paid a friend of mines little brother 50 buck to get it back. He beat the piss out of this punk and brought me my bike back. I paid him his 50 bucks and gave him the bike.

When I was 15 I paid $250 cash for a bike I always wanted with money I earned over the summer mowing lawns. It was an olive green Haro Shredder signed by Dave Mirra himself. It belonged to a friend of mine who used to ride BMX with Dave before he got big, and Dave gave it to him as a gift. He sold it to me because he knew how bad I wanted it.

3 weeks later it was stolen off my front porch. I had TWO of those metal "u"-shaped locks, they sawed right through the wooden railing it was bolted to.

When you're 15, $250 is a lot of money. I was beyond pissed.

I never found out who stole it, and the cops were absolutely no help. They stopped answering my calls. ****ing dicks.

My concept of entrapment is someone threatening me or someone I care about with violence and telling me they'll hurt or kill them if I don't commit a crime. Short of that, in my book it's not entrapment. You don't take what isn't yours from anywhere, no matter what.

Ereeves116: Where do you park your car? Is it bolted to the concrete, locked up in a garage or chained to something solid? If not, I need parts for my car. Since your car can easily be pulled from your driveway or street onto a flat-bed tow truck (even if the doors are locked) it's up for grabs based on your philosophy!

It's nice to see that I'm not the only one who thinks criminals should be punished.

It's like speeding tickets -- I break the law when I speed. I typically make a conscious decision to speed. If I get pulled over, I don't give the cop $h1t for catching me, even if they're tucked away out of sight to "catch me at it". I CHOOSE to speed, which is illegal, and they caught me fair and square, no matter where they were sitting. If the cop lets me off with a warning, I'm happy; but if I get a ticket, I know it's my fault and I pay it.

There are three main reasons I don't commit many crimes
1. I was raised to know what's right and what's wrong, and wasn't allowed to get away with and punished if I tried lying, cheating and stealing as a kid.
2. I wouldn't want it done to me
3. It's against the law, and if I got caught I would expect to be punished.

It's a crime of opportunity. If it wasn't that bike it would have been something else. Whether it was someones purse or your briefcase left out for a moment. Oh and it wasn't about not affording a lawyer, I did not need one, I just needed someone to the the paperwork for me and come with me to the proceedings. I was acquitted of the charges. Paid $300 instead of $1500 so the way I see it I knew what I had to do and say, I just needed someone to do the work for me. End result was the same.

Well if you read the yahoo post I was not guilty. The judge ultimately saw this. I got the movie eventually and I don't recommend watching it. Worst hours of my life, I thought that at least with robin williams voicing one of the characters it would be good enough. Bad idea!
