Ok guys, I know many have heard this a thousand times before, but I'm just gonna vent anyway:

Coming home from Darknights I took Elgin Mills. There was about 20 of us.
We are driving down the road and 2 cruisers block the road off so we can't pass.
Fine, they want to inspect us, no problem.
I'm around the 6th car down from the front, the cop comes to me and asks me to put my high and low beams on, rev the car to about 2k, put the car in reverse, put the hand brake on and give it throttle, and pop my hood: I can't even count how many question he asked me there.
Finally he says: "your car looks ok, but the muffler is quite loud. In fact it's the loudest one of the group, and I have an aftermarket exhaust too, and it's louder than that as well".
So he decides to give me a ticket for the muffler. It says Traffic Act Section 75(1) Improper Muffler.
Now, I'm thinking to myself, my buddies mustang has 4 staight pipes coming out and is louder than an atom bomb, but I find out later he didn't get a ticket.
On top of that, before I left, I said to the cop that I have a neighbour who's a cop and he said my muffler is ok, why am I getting this ticket?
The cop said "cops can't really judge what is ok and whats not ok, you need a specialist for that".
Now I'm thinking "WTF?? He just gave me a ticket,... so he's telling me that not even HE is qualified to give me this ticket?" :hand:

Anyway, I think the bottom line is you get a ticket if they feel like giving you one. End of story.
What a bunch of morons. :hammer:

He screwed himself when he said that a specialist is needed, take it to court and if he shows up make him repeat himself. That will be the end of your troubles.

If your neighbor is a cop and said it wasn't loud I would go to court. Maybe you can get a notarized statement from him to take to court. You also want to check the laws regarding mufflers.

It really all depends if you have the time and want to get involved w/the court costs. How much was your ticket?

That must definitely be annoying! But like 2GTS said, I think you should be able to get clear of it easily.

The ticket wasn't much.. $110.
But still, just the fact that he contradicted himself makes me want to fight it.

Maybe you can get a notarized statement from him to take to court. You also want to check the laws regarding mufflers.
To be more specific, that is exactly what I asked him. And of course he said that would NOT help. Of course I think he was just trying to avoid me getting the statement. And of course, I will get my cop friend to write one for me.
I also checked the highway traffic act section 75(1).

75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle. R.S.O. 1990, c. H.8, s. 75 (1).

I found this, not sure if it's the same "HOLLYWOOD MUFFLER TM
A blast from the past. The original Hollywood muffler in 100% stainless steel. Loud gutsy rumble." This was from a Muffler shop's website.

Court costs don't mean anything if you're innocent. You only pay court cost when you are found guilty and they would be part of the $110 ticket cost. If you look at the breakdown they give you when you pay at the court house the fine is usually only a 1/3 of the total ticket cost. The rest is admin fees, security fees for the balif to be present in the courtroom and taxes and other bs.

I say fight it, If the infraction happened out of your area you might be able to do a trial by decleration (don't know the laws up there) I did it in Cali once when a cop thought I ran a red light (I didn't). In this case you just type up a letter explaining your case, cite the appropiate sources (what kind of muffler you were using, the statement that cops can't judge muflers, your neighbors comments)

Do a good job of witing it and have other people read it over to make sure that it has good flow to it.

Single Wall Domed, Straight Cut
4" Tip Length
14" Muffler Body Length

It's not really the muffler that gives me the sound I have, its the combination of it and all of my engine mods and internals. A big part is the 272's.

Go to court, it'll be easy he'll probably just drop the charges.
It's a win win situation for the cop anyway. Even if he drops the charges, he gets paid overtime for showing up at the court.

Usually Ontario isn't bad, but seems like they were just waiting outside the biggest import show in the area waiting to get some "easy" money.

Those cops were just hovering around the show and I'm so thankful that I wasn't nailed for anything as well. I say fight it, what's the worst that can happen? You lose some time off work, that might be all. When I went to set a court date for my speeding ticket I sat in on a court trial with a guy defending himself and his muffler. The judge said, "so, did you do this for cosmetic reasons or is there a purpose." The guy answers, "oh I just like the way it sounds" ..... Justin - that's what NOT to say when you are up there. Everyone basically picked him apart. But the way the cop was answering the questions were a little funny. He said that he could tell it was a loud muffler because it was large in diameter - clearly larger than a stock muffler on his cop car. The kid tried to defend himself, saying that the cops windows were up and the sound couldn't have been that loud because his car was approaching the cop car in the other direction. The cop kinda got stuck when he was asked if he could hear the sound over his radio. I can't remember though if he used a device to measure the sound level...and I think in Ontario, you do need a device to measure the sound to determine if it is "excessively loud." Research that a little more....if he didn't stick a sound meter up the exhaust, then you may just be able to keep that $110 in your pocket. The cop has the ability to give you a ticket for tint if "in his own eyes" it looks too dark because of safety reasons without a meter.....but you can fight that and say, hey, he didn't have a meter. Might just be the same for exhaust. My ex got a ticket for exhaust, took it to court, cop never showed, ticket dismissed. Research and try to set a date.

actually I did the research..
and the Highway Traffic Act Section 75(1) I believe generally states that any aftermarket muffler isn't legal.
Plus the cop made me do tests to see how loud it was.
Yes, its true, he didn't have a meter,
But the guy also new what he was talking about.
And promised me he would show up, and bring his testing meter in the parking lot (which could have been just an empty threat).
Since my time at work is not something I can give up easily and this looks like its more trouble than its worth to fight, I may just have to pay it off.
